A Short Story: Once a upon a time in Bergland

Sometimes ago, a man and woman get married. After while they had few children. Then they separated. The husband loved his children as his wife. Both of them argued and argued without any conclusion even though they decided to get divorce. 

Now the problem is children. Technically in Bergland the wife has more rights and she will be eventually given total custodial rights of the children by the Supreme Court of the said country.

So the husband has a mala fide intention by converting himself to another godsdienst. He is converted and converted his children as well without the knowledge of his wife (now former wife). He took the children away and seek the authorities to help him in name of godsdienst.

The godsdienst authorities stepped in and give him full support and protection in the name of godsdienst.

The wife rights was deprived. So, she took the matter to the civil court and the said court told her that now she have to seek the remedy from the godsdienst court and not from them because they have no exclusive jurisdiction on this matter.

The wife was disheartened. 

The wife is questioning herself where was the mistake was done.

Firstly, both of them love their children. Both of them wanted their children but they can't stay together any longer. If both of them went to civil court and result will be in favour of the wife and therefore the husband took the short cut. Here the husband had an evil intention. Therefore the godsdienst authorities should have recognise this and advise the husband to consult with the wife (former by now) and express his intention to convert his children. This will be fair and just accordance with natural justice.

One needs to remember both parents have rights on children. If the children are minors then the choice of godsdienst need to be determined by the children once they reach majority or adults. Until then, the parents are duty bound to expose the godsdienst practiced by their parents.

Secondly, the rights of children need to be consider highly for any decisions pertaining the welfare and well being of them. The authorities or courts can't imposed any rulings which are undermined the rights of the children.

Thirdly, the godsdienst authorities should not allowed itself and must ask the husband who wanted to convert to get divorced from his wife and get consent from her to convert his children for his choice of godsdienst. This is issue between husband and wife. The godsdienst need to rescue from itself with kind of matrimonial disputes.

Finally, the rule of law and natural justice need be uphold all the times in accordance with the law of the Bergland.
